User Agreement

1. Acceptance of these terms

Welcome to iOrderTrack. This User Agreement is a binding contract between you and iOrdertrack LLC ("iOrderTrack," "we," or "us"). By creating an account, placing an order, or selling on iOrderTrack, you agree to be bound by these terms, our Privacy Notice, our Payments Terms of Use, and the other policies linked from this page. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old and legally able to enter a contract where you live. If you use iOrderTrack on behalf of a business, you represent that you are authorized to bind that business to these terms.

3. Your account

• You are responsible for keeping your password confidential.
• You agree to provide accurate, current, and complete information, and to keep it up to date in your account settings.
• We may suspend or terminate your account if we reasonably believe you have violated these terms or applicable law, or to protect the service or its users.

4. Buying on iOrderTrack

When you place an order, iOrderTrack routes it to the seller best able to fulfill it based on price, availability, and shipping origin. The order forms a contract between you and the winning seller; iOrderTrackacts as the marketplace and payment intermediary. Order, return, and refund details are in the Payments Terms of Use.

5. Selling on iOrderTrack

If you list products for sale, you also agree to our [Seller Code of Conduct] and the [Seller Operating Standards]. You are responsible for the legality, accuracy, safety, and shipping of every product you list. Prohibited categories (e.g. recalled goods, controlled substances, human organs, counterfeit goods, certain weapons) are enforced automatically and manually; repeated violations result in suspension.

6. Content you submit

When you post reviews, questions, answers, images, or other content, you grant iOrderTrack a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, display, reproduce, and distribute that content in connection with operating and promoting the service. You represent that you have the rights to grant this license.

7. Prohibited conduct

You agree not to:

• Use the service to break any law or someone else's rights;
• Send malware, spam, or other harmful content;
• Reverse-engineer or scrape any non-public portion of the service beyond a normal browser session;
• Misrepresent your identity, payment method, shipping address, or seller credentials;
• Interfere with allocation or pricing (e.g. coordinated wash-trading, fake clicks against affiliate links).

8. Intellectual property

iOrderTrack, the logo, and the underlying software are owned by iOrdertrack LLC and protected by copyright, trademark, and other laws. Nothing in these terms transfers ownership to you.

9. Disclaimers

iOrderTrack is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, iOrderTrack and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the service. Our total liability for any claim relating to the service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100 USD.

11. Indemnification

You agree to defend, indemnify, and hold harmless iOrdertrack LLC from any claims arising out of your use of the service, your content, or your violation of these terms or any law.

12. Termination

You may close your account at any time from your account settings. We may suspend or terminate your account if you breach these terms. Sections that by their nature should survive (e.g. ownership, license, disclaimers, limitation of liability, dispute resolution) will survive termination.

13. Governing law and dispute resolution

These terms are governed by the laws of the State of Florida, without regard to conflict of laws. Any dispute will be resolved by binding arbitration in Pinellas County, Florida under the rules of [arbitration provider], except that either party may bring a claim in small-claims court if it qualifies. You and iOrderTrack agree to bring disputes only in our individual capacities and not as a plaintiff or class member in any purported class action or representative proceeding.

14. Changes to these terms

We may update these terms from time to time. If a change is material, we will notify you at least 30 days before it takes effect by posting an update on this page and emailing the address on file. Your continued use after the effective date counts as acceptance of the change.
